Welcome to BetterCompany Interview, designed to help companies, employees, and candidates have more authentic conversations about work. These are the Terms of Service ("Agreement" or "Terms") between BetterCompany Interview ("We" or "Us"), a service of BetterCompany, and you that covers your use of the BetterCompany Interview Services ("Service") including the website at www.bettercompany.com. By accessing the Service, you agree to be bound by and to comply with these Terms. If you do not agree to these Terms, please stop using the Service.
BetterCompany Interview allows companies ("Administrators"), job candidates ("Candidates") and company employees ("Advocates") learn what it’s like to work at a particular company. These Terms apply to your account and exclusively govern your personal use of the Service. By using the Service, you agree that you are at least 18 years old, capable of entering into a contract, and that you will only use the Service according to these Terms.
As part of using the Service, you must create an account on BetterCompany Interview. All information you submit to the Services must be accurate. You may not transfer your account to any other person without express written consent from us.
You are responsible for your own account and what you say on the Service. You agree to use your account only to access the Service in compliance with these Terms, and to never use another person’s account without their permission.
Employers verify to us that Advocates who create accounts affiliated with a particular company are employed by the company. Otherwise, we do not verify users, user content, a user’s job, or the substance of their answers. However, if we learn of any inaccurate information shared on the Service, we will remove it and take reasonable efforts to remove the user and notify other users of the situation, as may be appropriate.
We reserve the right to suspend your account, revoke your access to the Service (or any part of the Service), or remove your content from the Service at any time and for any reason.
When you sign up for an BetterCompany Interview account, you agree to receive Service related short message service ("SMS") messages from us to your mobile devices via our SMS Service Providers. To choose to opt out of receiving SMS text messages from us, a recipient may reply to any SMS text message with the word "STOP" or may contact us at firstname.lastname@example.org. While we do not charge a fee to receive text messages, standard text messaging rates and other charges from mobile phone carriers may apply. We do not guarantee that text messages will be sent or will arrive, and you agree that we shall not be liable for any failure for a text message to arrive or any other technical problems related to text message delivery.
BetterCompany Interview contains graphics, text, photographs, software code, images, video, audio, software, code, website compilation, and the website "look and feel," all of which is our exclusive property. Our content is protected by intellectual property laws including copyright and other proprietary rights of the United States and foreign countries.
We grant you a non-exclusive, limited, and personal license to access and use the Content, including in the manner described in this Agreement. You may not otherwise make unauthorized commercial use of, reproduce, prepare derivative works, distribute copies, perform, or publicly display the Content, except as authorized in writing by us. We reserves all rights not expressly granted herein in the Service and the Content, which is defined below. We may terminate your license at any time for any reason or no reason.
You retain ownership of the rights iin the copyrighted content you contribute or post to the Service ("Your Content"), subject to the following. By contributing content via the Service, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to reproduce, prepare derivative works, distribute copies, perform, or publicly display your user content in any medium and for any purpose, including commercial purposes, and to authorize others to do so.
You agree not to contribute or post content that (i) may create a risk of harm to any other person or company, (ii) may constitute a crime or tort, (iii) is unlawful, (iv) infringes the intellectual property rights of others, (v) is invasive of personal privacy or publicity rights, (vi) constitutes harassment or a threat to others, or (vii) contains information that you do not have a legal right to post under any contractual or fiduciary relationship, including information protected by trade secret laws or non-disclosure agreements.
You agree that you are completely and solely responsible for Your Content and for your interactions with other users of the Service and for any disputes or consequences that may arise as a result of Your Content or interactions, including legal liability. We take no responsibility for, we do not expressly or implicitly endorse, and we do not assume any liability for Your Content.
You agree that Your Content may remain available on the Service even if your employment ends with your current employer or if you are hired by an employer or otherwise removed from the Service or if you delete the Service. However, if you would like to delete your content on the Service, please contact us at email@example.com and we will try to accomodate you at our discretion.
We response to legitimate copyright and trademark requests, and we retain the right to remove content on the Service for copyright or trademark reasons. Any copyright or trademark request should be sent to the following contact information:

It is our policy to delete the accounts of users we identify as repeat infringers.
BetterCompany Interview is a forum for people to discuss to discuss their jobs and professions, and our goal is to ensure that productive conversations occur on the service that benefit both job candidates and their employers. If you are a business and you learn that a user has submitted content to the Services that reveals trade secrets, discloses confidential information, or otherwise violates a non-disclosure agreement, you may alert us by sending a complaint to firstname.lastname@example.org. Upon receiving your complaint, we, in our sole discretion, will decide whether to remove content from the Service. Although we monitor the site, we cannot be responsible for knowing what is a trade secret. Therefore, nothing in this Agreement is intended to be a guarantee that BetterCompany Interview Services will remove information alleged to be a trade secret, confidential, or in violation of a non-disclosure agreement.
You agree not to interrupt the Service, introduce malicious code onto the Service, make it difficult for anyone else to use the Service due to your actions, attempt to manipulate or exceed authorized access to the Service, use any automated system or code to access the Service, or assist anyone in misusing the Service in any way.
We support the responsible reporting of security vulnerabilities. To report a security issue, please send an email to email@example.com.
YOU ARE RESPONSIBLE FOR EVERYTHING YOU SUBMIT OR POST ON THE SERVICE. SPECIFICALLY, YOU AGREE TO HOLD BETTER COMPANY, HONEST INTERVIEW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND THIRD PARTY SERVICE PROVIDERS HARMLESS FROM AND INDEMNIFY HONEST INTERVIEW AGAINST ANY CLAIMS, COSTS, DAMAGES, LOSSES, EXPENSES, AND ANY OTHER LIABILITIES, INCLUDING ATTORNEYS’ FEES AND COSTS, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICE, YOUR VIOLATION OF THIS TERMS OF SERVICE, YOUR CONTENT OR ANY INFORMATION SUBMITTED VIA THE SERVICE; OR ANY OTHER PARTY’S ACCESS AND USE OF THE SERVICE WITH YOUR USERNAME, PASSWORD OR OTHER ANY OTHER INFORMATION UNIQUE TO YOUR ACCOUNT, AND/OR YOUR VIOLATION OF THE RIGHTS OF ANY THIRD PARTY OR PERSON.
BetterCompany Interview IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES AND THIRD PARTY SERVICE PROVIDERS DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON- INFRINGEMENT OF PROPRIETARY RIGHTS, OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL OR ELECTRONIC. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR MOBILE DEVICE, LOSS OF USE, OR LOSS OF YOUR CONTENT. WE DO NOT GUARANTEE THAT THE SITE OR SERVICE WILL ALWAYS WORK PROPERLY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HONEST INTERVIEW ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES, WHETHER IN TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, REGARDLESS OF WHETHER THOSE DAMAGES ARISE FROM OR ARE THE RESULT OF (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES,OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; (VII) ANY IMPACT ON YOUR EMPLOYMENT OR ANY POTENTIAL EMPLOYMENT OPPORTUNITIES; AND/OR (VIII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY.
THIS LIMITATION ON LIABILITY SHALL NOT BE AFFECTED EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW FOR THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
YOU AGREE TO RELEASE US, OUR AFFILIATES, AND THIRD-PARTY SERVICE PROVIDERS, AND EACH ASSOCIATED DIRECTOR, EMPLOYEE, AGENTS, AND OFFICERS, FROM CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL), OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR USE OF THE SERVICES .

ANY CLAIM OR DISPUTE BETWEEN YOU AND US ARISING OUT OF OR RELATING TO THIS TERMS OF SERVICE, IN WHOLE OR IN PART, SHALL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA WITHOUT RESPECT TO ITS CONFLICT OF LAWS PROVISIONS. WE AGREE AND YOU AGREE TO SUBMIT TO THE PERSONAL JURISDICTION AND VENUE OF THE STATE AND FEDERAL COURT LOCATED IN SAN FRANCISCO COUNTY, CALIFORNIA.
This document constitutes the entire agreement between you and BetterCompany Interview Services. Any change to any part of this Agreement must be in writing and signed by both you and Honest Interview Services in order to be valid or enforceable.
If any part of these Terms is held invalid or unenforceable, that provision will be modified to the extent necessary to render it enforceable without losing its intent. If that is not possible, the provision will be severed from the rest of this document.
Our failure to enforce any part of this agreement is not to be deemed a waiver of our right to do so in the future.
This is the entire agreement between you and BetterCompany Interview concerning the Service. It supersedes all prior or contemporaneous agreements between you and us. We may modify this agreement at any time. If we make changes to this agreement that materially affect your rights, we will provide advance notice via the site. By continuing to use BetterCompany Interview Services after a change to this Agreement, you agree to those changes.
The headings in this agreement are for convenience and do not control any of its provisions.
